Spire 45 Day Satisfaction Guaranteed Return Policy

If you are unsatisfied with your purchase from Spire.live for any reason, you have 45 days from the date of purchase to request a full refund. You may return any Product (as defined below) purchased on Spire.live in accordance with the terms below.

To qualify for a refund, all the following conditions must be met:

  • A return authorization must be requested from our customer service team within 45 days of your purchase date. To request a return authorization, please contact customer service here.
  • You must return the Product to iZotope to receive a refund. Returned Product(s) must be in good physical condition (not physically broken or damaged). All accessories originally included with your purchase must be included with your return.
  • The return authorization number must be included along with your returned product.

Additional terms and conditions:

  • Shipping and handling charges, gift wrap fees, and taxes paid (such as state, customs, or VAT) are not refundable.
  • You are responsible for and you assume the risk of loss or damage to the returned Product(s) while in transit back to iZotope.
  • If you return Product to iZotope (a) without a return authorization from iZotope or (b) without all parts, packaging and accessories originally included with your purchase, iZotope retains the right to either refuse acceptance of such return.

LIMITED WARRANTY

 

THIS IZOTOPE, INC. (“IZOTOPE”) SPIRE STUDIO™ LIMITED WARRANTY (‘LIMITED WARRANTY”) CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

TOTAL SATISFACTION RETURN POLICY
If You are the original purchaser of the Spire Studio hardware recording device and any accompanying accessories (collectively, “Product”) forom iZotope and are not completely satisfied with the Product for any reason, You may return it, within forty-five (45) days of the date of purchase (“Purchase Date”), for a full refund of the price paid for the Product at the time of purchase (“Purchase Price”); provided, however, that You (i) request and obtain a return authorization number from iZotope Customer Care at spire.live/support; (ii) return the Product in good condition (not physically broken or damaged), together with any accessories that were included with Your original purchase; and (iii) include the return authorization number with Your return. Notwithstanding the foregoing, any Product purchased in the months of November or December of any calendar year may be returned up until January 31st of the following calendar year or the date that is forty-five (45) days from the Purchase Date, whichever is longer.

For purposes of calculating refunds, the Purchase Price shall not include any shipping and handling charges, other packaging fees, and taxes paid (including, but not limited to, federal, state, local, customs, and/or value-added taxes). You shall be responsible for and assume the risk of loss or damage to any returned Product while in transit back to iZotope, up until the point of receipt by iZotope at the address provided with Your return authorization. If You return a Product to iZotope without (i) an original purchase receipt; (ii) return authorization from iZotope; and (iii) all parts, packaging, and accessories included with Your original purchase, iZotope reserves the right, in its sole discretion, to refuse acceptance of the return, offer only a partial refund or offer no refund, depending upon the circumstances surrounding the return and the condition of the Product upon receipt.

LIMITED WARRANTY; PERIOD OF COVERAGE
iZotope warrants to the original purchaser registrant of the Product that the Product will be free from defects in materials and workmanship, under conditions of normal and expected use, for a limited period of time (“Limited Warranty”) equal to one (1) year from the Purchase Date (“Warranty Period”). If the Product fails to conform to this Limited Warranty and You submit a claim, according to iZotope’s claim process (Please see below “Limited Warranty Conditions; Service of Claims”), during the Warranty Period, iZotope will, at its sole discretion and as allowed by applicable law, either (i) repair the Product using new or refurbished replacement parts or (ii) replace the Product with a new or refurbished Product, either at no cost to You, provided shipment originates within the continental United States (cost for shipment from outside the continental United States shall be paid by You. If the Product or a necessary part therein is no longer available, iZotope may, at its sole discretion, replace the Product with a similar product of comparable function and value.

This is Your sole and exclusive remedy for breach by iZotope of this Limited Warranty, which is applicable only in the jurisdiction in which the Product is originally purchased, either from iZotope (or from an authorized iZotope agent or reseller), and is valid only to the extent allowed by applicable law in such jurisdiction. Any Product that has previously either been repaired or replaced under this Limited Warranty will be covered by the terms of this Limited Warranty for the longer of (i) thirty (30) days from the date of delivery of the repaired or replacement Product and (ii) the amount of time remaining in the Warranty Period; or (iii) for any other amount of time as may be required by applicable law. This Limited Warranty is available to the original purchaser/registrant of the Product from iZotope (or an authorized iZotope agent or reseller) and is not transferrable to any subsequent owners of the Product.

LIMITED WARRANTY CONDITIONS; SERVICE OF CLAIMS
In order to make a claim under this Limited Warranty, the owner/registrant of the Product must (i) notify iZotope of Your/their intention to claim by contacting iZotope Customer Care at spire.live/support during the Warranty Period with a description of the alleged failure; (ii) obtain a return authorization number, which must be included with Your returned Product; (iii) package the Product in its original packaging or other similar packaging that is at least as protective; (iv) return the Product to the address specified by iZotope Customer Care; and, where required by applicable law, (v) furnish iZotope with proof of purchase details; as well as (vi) comply with any other requirements that may be issued by iZotope from time to time.

iZotope will bear all costs of return shipping provide You with a prepaid RMA for return shipping within the continental United States and will reimburse any shipping costs incurred by You, except with respect to any Ineligible Product (Please see below “Warranty Exclusions; Ineligible Products”), for which You will bear all shipping costs. It is Your responsibility, prior to return of any Product in connection with a claim under this Limited Warranty, to back up any data, software or other materials that You may have stored or preserved on the Product (“Your Materials”). IT IS LIKELY THAT YOUR MATERIALS WILL BE LOST OR REFORMATTED DURING SERVICE OF ANY CLAIM UNDER THIS LIMITED WARRANTY, AND IZOTOPE SHALL NOT BE RESPONSIBLE FOR ANY SUCH LOSS, DAMAGE OR OTHER EFFECT ON YOUR MATERIALS.

WARRANTY EXCLUSIONS; INELIGIBLE PRODUCTS
This Limited Warranty does not cover software embedded in the Product or any services provided by iZotope in support of the Product or otherwise. Please see the Spire Terms of Use for information about Your rights with respect to use of any such the related software and services. iZotope does not warrant that the operation of the Product will be uninterrupted or error free. This Limited Warranty does not cover the following (collectively, “Ineligible Products”): (i) Products marked as “Sample” or “Not for Sale” or that are sold “AS IS”; (ii) Products that have been subject to: (a) modifications, alterations, tampering or improper maintenance or repairs; (b) handling, storage, installation, testing or use not in accordance with a user’s manual or other instructions or product information provided by iZotope; (c) accident, abuse, misuse or mishandling; (d) breakdowns, fluctuations or interruptions in electric power (including use with improper voltage or power supply) or the telecommunications network; (e) use outside of the permitted or intended purpose as described by iZotope or in accordance with iZotope product information; or (e) Acts of God, including, but not limited to, lightning, flood, tornado, earthquake or hurricane; (iii) any Product not purchased from iZotope or from an authorized iZotope agent, reseller or sales channel; and (iv) non-iZotope and iZotope-branded products (i.e., products not marked with iZotope’s trademark, trade name, logo, and/or other verifiable authorization, certification or registration number) or counterfeit products, even if packaged or sold with iZotope hardware. This Limited Warranty does not cover accessories or consumable parts, including batteries, unless damage is due to defects in materials or workmanship of the Product. iZotope recommends that You use only authorized iZotope service for maintenance or repair of the Product. Unauthorized use or repair of the Product or software can impair the Product’s performance and may invalidate this Limited Warranty.

SHIPPING
For individual end users who purchase the Product directly from iZotope at spire.live, iZotope provides free standard shipping in the continental U.S. and a paid option for expedited shipping. For direct returns from end users, iZotope will issue a UPS return label and pay for return shipping fees. iZotope provides free shipping to Channel Agents on orders over Five Thousand Dollars ($5,000) in Product value (exclusive of taxes and fees); whereas, for orders below Five Thousand Dollars in Product value (exclusive of taxes and fees), the Channel Agent shall pay the shipping fees. .

DISCLAIMER OF WARRANTIES
EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, IZOTOPE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT AND FITNESS FOR A PARTICULAR PURPOSE. TO IZOTOPE ALSO LIMITS THE DURATION OF ANY SUCH APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY.

LIMITATION OF DAMAGES
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL IZOTOPE BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY OR SPECIAL DAMAGES (EVEN IF IZOTOPE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), INCLUDING, BUT NOT LIMITED TO, ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND IZOTOPE’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT SHALL NOT EXCEED THE PURCHASE PRICE OF THE PRODUCT.

LIMITATION OF LIABILITY; PRODUCT INFORMATION
IZOTOPE PROVIDES YOU WITH CERTAIN INFORMATION ABOUT THE PRODUCT IN VARIOUS FORMATS (INCLUDING, BUT NOT LIMITED TO, ONLINE, PRINTED, VIDEO, AND AUDIO FORM) (“PRODUCT INFORMATION”). THE TYPE OF PRODUCT INFORMATION THAT MAY BE CONNECTED TO YOUR PRODUCT MAY CHANGE FROM TIME TO TIME. WITHOUT LIMITING THE GENERALITY OF THE DISCLAIMERS ABOVE, ALL PRODUCT INFORMATION IS PROVIDED FOR YOUR CONVENIENCE ON AN “AS IS” AND “AS AVAILABLE” BASIS, AND IZOTOPE DOES NOT REPRESENT, WARRANT, OR GUARANTEE THAT PRODUCT INFORMATION WILL BE AVAILABLE, ACCURATE, OR RELIABLE OR THAT PRODUCT INFORMATION OR USE OF THE PRODUCT IN ACCORDANCE WITH THE PRODUCT INFORMATION WILL PROVIDE ANY PARTICULAR OR CONSISTENT RESULT. YOU USE THE PRODUCT AND ALL PRODUCT INFORMATION AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR (AND IZOTOPE DISCLAIMS) ANY AND ALL LOSS, LIABILITY OR DAMAGES RESULTING FROM SUCH USE.

YOUR RIGHTS AND THIS LIMITED WARRANTY
This Limited Warranty gives You specific legal rights. You may also have other legal rights that vary by state, province, or jurisdiction. Likewise, some of the limitations in this Limited Warranty may not apply in certain states, provinces or jurisdictions, where national laws governing the sale of consumer goods, including, without limitation, national laws implementing EC Directive 99/44. These rights are not affected by the warranties in this Limited Warranty. The terms of this Limited Warranty will apply to the extent permitted by applicable law. For a full description of Your legal rights You should refer to the laws applicable in Your jurisdiction and You may wish to contact a relevant consumer advisory service.

GOVERNING LAW
This Limited Warranty is governed by the laws of the Commonwealth of Massachusetts (USA), without giving effect to any conflict of laws principles that may provide the application of the law of another jurisdiction.

If You are an authorized distributor or reseller of the iZotope Product, the following additional terms shall also apply to You:

RETURNS
In the event that an iZotope distributor or reseller (each a “Sales Agent”) receives any Product from iZotope or its authorized manufacturer that does not constitute an Ineligible Product and is damaged or defective when delivered, then the Sales Agent may, within forty-five (45) days of the date of delivery (“Delivery Date”) and at its own expense for return freight, return the Product for a new replacement Product, to be shipped within fourteen (14) days of iZotope’s receipt of the returned Product (“Return Period”); provided, however, that (i) the Sales Agent follows the Service of Claims process prescribed under the Limited Warranty and (ii) iZotope is able to verify the claimed damage or defect (iZotope does not allow Products that are the subject of a claim to be destroyed in the field).  If iZotope is unable to verify the claimed damage or defect, then iZotope shall return the Product to the Sales Agent and levy a surcharge equal to fifteen percent (15%) of the Product’s Purchase Price against the Sales Agent’s account. In rare circumstances and whether or not a returned Product has been verified by iZotope as damaged or defective, iZotope may, in lieu of a return or replacement, issue the Sales Agent, prior to the end of the Return Period, a credit against its account equal to (i) the Purchase Price (where iZotope was able to verify the claimed damage or defect) or (ii) the Purchase Price minus a surcharge equal to fifteen percent (15%) of the Purchase Price (where iZotope was unable to verify the claimed damage or defect). iZotope shall not allow for or accept any returns from the Sales Agent not necessitated by damage or defect.

SHIPPING
iZotope provides free shipping to Sales Agents on orders over Five Thousand Dollars ($5,000) in Product value (exclusive of taxes and fees); whereas, for orders below Five Thousand Dollars in Product value (exclusive of taxes and fees), the Sales Agent shall pay the shipping fees.
